This is why choosing a bankruptcy attorney in this city is one of the hardest tasks possible. In addition to searching for these lawyers on the internet, you may even have to go to their offices and have a fact to face conversation with most of them. The difficulty of shortlisting excessively on the internet is evidence of the fact that you will see numerous lawyers with good ratings. For instance, if you go on one rating website, you will see a completely different list of ratings than another rating website. This is bound to create a great deal of confusion. In addition to this, even if you rely on blogs and forums to clear some of your confusions, you will eventually realize that it will not be able to solve your problem alone. This is because some people may have had a good experience with the same attorney while others may have had to go through a number of complaints. This is why self-judgment is always the best solution.

So many people have been afflicted by financial crises that the demand for bankruptcy lawyers has grown quite rapidly. Make sure you attain all the relevant information from their assistants as there is a very slim chance that you will be able to get an early appointment with the attorney. Do not forget that this is a matter of your entire financial history and one on which the future of your finances depends as well, so you need to rake out as much time as possible to find the right attorney to deal with your case. A conversation with the assistants combined with some online reviews as well as reviews from people you know is bound to get you a step ahead in planning your bankruptcy.
After you have shortlisted a few attorneys, try to get an appointment with each one of them and see how well they address your concerns. You will notice a considerable difference between the attorneys who are ready to listen to you and care about your financial problems, and those who just want to get the job over with and are not that flexible to your concerns. You should stay away from the attorneys who do not seem to exhibit a personal interest in your affairs as they will most probably not be able to solve your problems in the most satisfactory way. In addition to this, you need to find a lawyer who is honest enough to tell you if you do not need a bankruptcy, and be able explain all the technical aspects using a lay man's language.

File Bankruptcy Under Supervision of a Bankruptcy Lawyer

Bankruptcy is a section in federal law that governs those laws and regulations pertaining to people who end up in so much debt that they cannot recover from it. This section of the federal law is designed to enable such people to recover from their debt and make a fresh start. This is done by giving them a longer time period margin in which they have to pay back all their debt and by even reducing the total debt amount by a certain percentage. All bankruptcy laws are distinguished from each other based on the chapters of the Bankruptcy Code in which they appear. There are a total of five chapters for all types of debtors and out of these five chapters three pertain to individuals. These chapters are Liquidation (chapter 7), Reorganization (chapter 11), and Reorganization (chapter 13).
Whether you are an individual or a business facing liens, lawsuits, repossession, wage garnishment, or foreclosure you should definitely hire a bankruptcy lawyer to help you solve your financial problems the efficient way. Finding a good bankruptcy lawyer is the first and most important step in this whole process. There are multiple resources that you can consult to find the perfect bankruptcy lawyer for you but always ensure that the lawyer you hire is from your area rather than any other area. This is because the laws and regulations differ from one state to another and only those lawyers who have been practicing bankruptcy cases in your area will be able to handle your case better. Therefore stick to the list of bankruptcy lawyers working in your state.
You can try getting a list of all bankruptcy lawyers working in your state from the yellow pages or through an online directory. Once you have tracked down a list run some preliminary background check to see which ones are the most reputed ones. The ones with most experience should be your first priority. Contact them and arrange for a free consultation session. If the lawyer does not offer a free consultation session then you should switch to someone else. These lawyers already charge a pretty high fee and since you are filing for bankruptcy it's obvious that you do not have enough cash to just throw around. Therefore avoid the most costly lawyers and stick to the ones offering free consultation.
When attending your free consultation session always notice the lawyer's habits. Lawyers who are keen about timings and are more organized can be trustworthy and reliable. Another important factor to look out for is how comfortable you feel with that person. Since you will be spending a great deal of time with that person in the future you need to ensure that the two of you click, understand each other, and you feel comfortable with him or her. Only then can you work well together. Always check out at least four or five bankruptcy lawyers before finally settling on one. Carefully planning all these things will help you find a good bankruptcy lawyer who will successfully take you through your case.
One last thing you should analyze is the size of the firm your bankruptcy lawyer is working for. Here the opinion of experts differs. Some people prefer hiring lawyers who work for really large and famous law firms whereas some people prefer hiring lawyers working for smaller firms. The problem often associated with big law firms is that they usually have so many cases lined up that they fail to give you the personal attention you need. On the other hand smaller firms have fewer cases and dedicate much of their time to it to ensure a strong name from winning those cases.

Filing the Bankruptcy Petition

When your bankruptcy attorney hands you the bankruptcy petition to sign, you need to review the petition with great detail. When a person signs their bankruptcy paperwork, they do so under penalty of perjury, but that is just the first concern. Also important with all bankruptcy petitions is the complete inclusion of all of your creditors.

Failure to provide the bankruptcy court and the bankruptcy trustee with accurate and complete petitions can result in severe consequences. These can range from perjury, your case being dismissed, or a debt not being discharged upon completion of the bankruptcy. Of course the law is not in place to punish or harm an honest mistake and certain mistakes can be fixed if they are caught within a reasonable amount of time.

One of the most common mistakes that is often made when a person files for bankruptcy is when they accidentally leave a creditor off of the petition. Once again, as long as this is caught in time there might be time to rectify this situation. However, if this is not caught in time there is a great chance that the debt will not be dischargeable upon completion of the bankruptcy process.

There are other issues that can arise. Many times a person might owe a debt to a friend or a relative and they would like to keep this person out of the bankruptcy and thus protect their financial interest. Unfortunately the bankruptcy laws do not allow you to pick and choice which debts you are willing to pay and which you would like to discharge when dealing with unsecured creditors. Should the bankruptcy trustee or the Judge become aware that you have knowingly failed to include certain creditors, it could be deemed as fraud and lead to adverse actions against you. The trustee might even start to question your entire bankruptcy petition and make a relatively simple process much more complex.

Finally, be completely honest with your bankruptcy attorney. The laws have been written to protect the good, hard working, honest American who has fallen on hard times. If you choose to try and hide assets, lie under oath, or commit any other fraud the penalties can be quite severe. It is just not worth it. Your lawyer will be your biggest advocate and offer you advice on the best way to move forward, but the only way they can do their job is with your help and honesty.

Tips For Choosing The Right Bankruptcy Attorney

Bankruptcy can be stressful. Don't add to the problem by hiring an inadequate attorney. Such representation can hinder your bankruptcy outcome. Finding the right attorney for your situation can be overwhelming. When struggling under a huge debt load, it may seem logical to hire the cheapest firm available. However, that could cause serious damage to your case. Cheaper is not always the best way to go in bankruptcy. Your legal rights and financial future are at stake.

If you hire an inexperienced attorney, the case might get dismissed, that means you would have to re-file the case. When re-filing the case, the automatic stay (that protects you from your creditors) is only for 30 days active. Within that time period, you would have to file a motion to extend the stay with no guarantee that the court will extend the stay.

First of all, narrow down your search to two or three candidates. Always choose an attorney who has experience and specialized in bankruptcy law. Whether you look in the phone book, search online, or watch a TV commercial, finding an attorney can be time consuming, but it's necessary. Don't procrastinate, but don't rush into the first option available either.

Online Search

Check out your state's bar association website to make sure your attorney is in good standing. Study the attorney's website for more information about the firm. Many sites post client referrals. Search the firm's history, caseload, and certifications.

Recommendation:

Recommendations from friends and relatives may be fine for some, but others may feel embarrassed about sharing their financial woes with a gossiping "mother-in-law." Find someone who's had personal experience with bankruptcy.

Consultations

Many attorneys offer free consultations. Prepare a list of questions ahead of time, and be informed about your options. This will make the process easier for both you and the attorney. Take note of the attorney's response time. If it takes them a week to call you back, you may need to find someone with a smaller caseload. Visit more than one firm before making your decision.

Questions to ask

(a) Ask about the attorney's caseload. Your case is important and you don't want it to be shuffled into oblivion.

(b) Inquire about the attorney's expertise and which other areas of law they handle.

(c) What is the attorney's fee? All fees should be agreed upon upfront and not tacked onto the bill later.

Important Reminders

Finding an attorney may be the most important decision you'll make in your bankruptcy experience. Find one that works well for your individual financial situation.

How Alternatives To Bankruptcy Can Harm Your Finances Rather Than Helping

Filing for bankruptcy will ruin your credit, but over time, it can be repaid. Some folks rush into filing for bankruptcy without even contemplating substitute pathways, such as debt consolidation, credit counseling and loan modification that can save a debtor's credit score. However, just because different choices exist, does not mean everyone who applies will qualify, as some pathways will not help obtain feasible payments or you may just have too much debt to handle. Before you decide on an alternative, you must be sure it will help reduce or eliminate your debt, as sometimes it is better to just file for bankruptcy than spend money and time repaying an ever increasing debt.

Credit Counseling

What some folks may find after speaking with a credit counselor is that after establishing a new financial plan, it is still going to be years before all debt can be repaid. Your new financial plan may make it difficult to waste any money on additional activities, such as movies or dining out, and even your current income cannot help you pay for all the debt with a new plan. If you see yourself as one of the individuals who will take 15 or more years to finish repaying their debt, it might be a good choice to just file for bankruptcy. You can get in contact with a local Southern California lawyer, and you can employ almost any legal counselor, such as a Woodland Hills bankruptcy attorney, if you are someone who lives in the L.A./Santa Monica vicinity.

Debt Consolidation

For a lender, it is better to collect some of the debt than get none of it at all, which is why most creditors will permit a debt consolidation alternative to help minimize the loss in lent money. If you want your debt consolidated, you will have to get a professional who specializes in this department in order to get lower payments. You might discover that even with debt consolidation, it still may not aid your problem, and combined with having to pay a professional to negotiate new terms, it is just not ideal. Before you speak to a professional, do some math work and calculate how much debt you owe and how much income you have per month. If it takes you 20 or more years to repay all your debt even after consolidation, you might be better off filing for bankruptcy.

Bankruptcy is not the most attractive selection for people looking to divest themselves of their debt, but it does come in handy in most cases. Remember, you can always speak with a local Thousand Oaks bankruptcy attorney or any other lawyer to get a free consultation and estimate of the costs for filing.

The New Regulatory Landscape for High Frequency Trading in 2012

Traders who take part in high frequency trading are using advanced technologies in their desire to be successful. They trade securities such as stocks or options using very sophisticated computerized algorithms. There is a frantic pace to high frequency trading. Positions are held for very brief periods of time, sometimes for no more than just a few seconds. These traders may literally make thousands of trades every day. Usually these traders are employed by large diversified firms. One of the biggest problems of this type of trading is the sensitivity it has to the markets' processing speed.

On May 6, 2010, the Dow Jones Industrial Average dropped approximate 1,000 points. This event has become known as the "flash crash." Fortunately, within a few minutes, it had recovered this loss. The loss, however, was the single biggest loss in the history of the Dow Jones Industrial Average. The event was investigated for nearly five months. Eventually it was determined that this wild swing was, in all probability, caused by high frequency trading. Because of this, this type of computerized trading has been under very close scrutiny by the United States Securities and Exchange Commission.

One of the things that the SEC has been closely examining is co-location. This involves the location of dealers and file servers. The difference in time of as little as a millisecond can make a huge difference in these types of trades. Companies which utilize co-location are seen to have an unfair advantage, and this is something that the SEC is attempting to eliminate.

There is also a concern that this type of trading can have negative effects on investors all over the world. This is to be expected when one considers the fact that more than 65% of all stocks traded are done so with this trading method. Many regulatory agencies around the world are attempting to completely eliminate this type of trading. They see the use of extremely high-speed computers as the giving of an unfair advantage to certain traders.

Other issues that the SEC is looking into are dark pools trading and naked access trading. With dark pools trading, prices are not displayed. With naked access trading, brokers allow clients to make trades without supervision. All of these are still legal, but more and more, scrutiny will be placed on traders to ensure fairness and to make sure there are no more flash crashes.

Wealth Creating Opportunities From Different Investment Options

Creating wealth will be more effective if you know where to put your money. Most of the time, investments options are the main choice for people who want to see their wealth grow because wealth creating takes more than your skills in managing your savings but also on the techniques you use to make it grow. One of the investment options is mutual funds. There are many benefits you can take advantage of when it comes to investing in mutual funds, but the most popular of it all is its ability to provide investing power even to average wage earners. This means that an investor need not have the largest amount of investment capital in order for him or her to take part in mutual fund venture.

The reason is that mutual funds are usually one of the investment vehicles that are most affordable in the investment market as compared to other financial options that offer investment opportunities. In addition to its affordability, mutual funds also provide investors versatile and flexible terms. But with all these investment opportunities and the chance to earn profits, investors have to understand that should they decide to pull out their investment share in the mutual fund even before its maturity, they are required to pay a particular amount for fees and other related penalty charges for early withdrawal even if not all financial institutions implement penalties and other related charges should an investor decides to withdraw his investment.

Another investment option you can use to seed your wealth is through fixed annuity investments. The fixed annuity can be compared to bank CD's in many major ways. The only difference lies in the fact that most fixed annuity funds are designed for the retirement plans of investors. For the most part, fixed annuities are considered as low risk investment vehicle and it can be easily converted into cash as compared to conventional bank CD's. And because the payouts for fixed annuities can be deferred, this financial product often provides higher returns as compared to bonds or CD's.

Fixed annuities can be categorized as either deferred, where you will make your contribution to the funds on an installment basis or immediate fixed annuity, where you can make a onetime payment for the total amount of the fund's premium based on the prevailing rate in the market. Typically, a fixed annuity can feature a single upfront premium and the agreement between the investor and the provider will be fixed on a single interest rate guaranteed by the provider for the duration of the fund which could be for several years depending on the policies implemented by the provider.

Planning wisely for your investment is one of the keys to building your wealth. Although it would be better if there is a financial expert to manage your investment, it does not mean that you have to be complacent and allow your investment to grow on its own. So, even when you invest in mutual funds or annuities, you still need to assess it by yourself to know whether or not your investment is growing.

Show Me the Money: Benchmark Study by Prudential Sheds Light on Black Wealth Creation

A recent study by financial behemoth Prudential Insurance Co., "The African-American Financial Experience" reveals that African Americans are a strong and growing market for financial firms but also identifies impediments to African American wealth creation. We are an important, powerful, and integral part of the American landscape, comprising an influential and growing population that tends to be younger than the general market with a rapidly emerging middle class and affluent segment, according to Charles Lowrey, Prudential Executive Vice President and Chief Operating Officer. Counter-balancing the generally positive outlook for African-American financial success are significant self-imposed impediments to wealth creation. Understanding the financial concerns and aspirations of the our community is key for any financial professional looking to build upon these strengths.
First the Good News
One of the study's primary findings is that Black wealth and income are both improving as a group. Affluence, Education, and Homeownership rates have all increased vis-a-vis previous generations. The majority of respondents, 58%, were considered "Emerging Affluent" (a term which I really love) with annual incomes over $50,000. Moreover, when compared to the general population, blacks express more confidence in the nation's economic prospects, a key indicator of an individual's willingness to spend and or invest. While only 37% of the general population thinks the economy will improve any time soon, according to a USA Today/Gallup Poll released in September, nearly twice as many African Americans, 62%, believe the economy will recover within the next two years.
Not only did the Prudential study find the black Americans to have increasing affluence and income with an optimism on our economic prospects, it also found the black community to be fertile ground for increased business relationships with financial professionals. The majority of those surveyed recognized the need for sound financial advice and believed that working with a financial professional is an excellent way to obtain that advice. Only 25% of the African American population has a relationship with a financial planner, whereas nearly 35% of the general population has an adviser relationship. In fact, 85% of the study's respondents agreed with the statement "I would like advice on saving and planning for retirement, but I can't find a professional I can trust." Blacks who use advisers are precisely the type of client most advisers spend countless dollars prospecting for. They tend to be older, more affluent, own their own home and have families. This all translates into an excellent opportunity for advisers serving the Black community.
The study also found that the goals of African American clients resemble goals held by the general population at large. This supports the real-life experience of professionals in the field. In an article appearing in lifehealthpro.com Lazetta Rainey Braxton, CFP, founder of advisory firm Financial Fountains in Chicago, says that her black clients are mostly concerned about:
• Ensuring their estate planning documents reflect their wishes
• Maintaining tax efficiency with their financial accounts
• Properly allocating their investments and align those investments with their lifestyles
• Understanding Medicare and long-term care coverage
• Balancing their financial needs with the needs of their children and grandchildren
The Prudential study found that survey respondents rated "educating children about debt avoidance, providing college tuition, and passing money on to heirs as very important, significantly more often than did the general population." Additionally, the study found that "African-Americans are significantly more likely than the general population to cite charitable donations as an important financial goal" according to Rhode Island financial planner Ed McCarthy CFP in a recent article appearing on lifehealthpro.com.
Now the Bad
Some of the most alarming information gleaned from the Prudential study concerned our usage of retirement plans like 401K's. The study revealed that regardless of age and income, African Americans and Hispanics are less likely to participate in their company 401K plans, and when they do contribute, the savings level is much lower rate than whites and Asians. In this regard, the study's, findings were similar to those of the 2007 Ariel/Hewitt report which examined the savings disparities across racial and ethnic groups by sampling 3 million employees at Fortune 500 companies. The Ariel/Hewitt report found that plan participation among blacks was roughly 10% lower than that of the general population.
Not only are African Americans less likely to contribute to company retirement plans but we are more likely to withdraw or borrow money from the plans before reaching retirement. The Prudential study found that blacks workers are three times as likely to withdraw funds or borrow finds from their 401K than the general population. Of African American respondents, 24% had taken a loan against their 401K versus 8% of the general population. Nearly 18% say they made a withdrawal from their 401K versus 6% of the general population. "The challenge of meeting day-to-day expenses in a difficult economic environment has caused African American financial decision makers to make choices that help them solve immediate problems at the expense of their long-term goals." Put differently, African Americans seem to view their retirement accounts as short term savings tools-like Christmas club accounts-rather than long term investment vehicles not to be touched until their golden years.
Finally, according to the Prudential authors, Approximately 40% of African American households, as opposed to roughly 30% of the general population, cite high levels of debt and conversely a lack of disposable income as a significant hurdle to wealth creation. Thus, "the African American respondents were significantly more likely than the general population to indicate that reducing debt and improving credit-worthiness and educating children about debt avoidance are critical or very important financial goals." While carrying high levels of household debt is an impediment to financial success the authors note that "the fact that African Americans recognize the importance of maintaining or regaining their good credit, and are focused on addressing this critical issue, is a very positive sign."
Takeaways
The Prudential study, like previous studies examining the disparities between races when it comes to wealth accumulation, arrived at the conclusion that African Americans lag behind the general population in terms of saving and investment holdings. However, the Prudential authors note that, "similar to the general population, African Americans are keenly focused on saving, lowering their debt burden, and seeking information to become more knowledgeable about financial products." But what would cause African Americans to lag behind the general population if the desire is to improve financial conditions? The study points to the fact that many in the African American community do not trust financial services firms to act with their best interest at heart. According to the study: "Although the majority say they want financial advice, concerns about finding 'a qualified professional they can trust and relate to' prevent many [African Americans] from hiring an advisor." Author and Washington Post Financial Columnist Michelle Singletary wrote of the Prudential study: "That's not a perception. Many financial services companies have taken advantage of consumers, including African Americans. We only have to look to the recent financial crisis to find evidence of deception and predatory lending practices. African Americans and Hispanics were disproportionately steered into higher-priced loans despite the fact that many - based on their income and credit profile - would have qualified for the best-priced terms." She writes that financial services companies should come into African American communities and educate before they attempt to make sell.

How to Find a Bankruptcy Attorney Suitable for You?

Bankruptcy can be a life changing event and it may take longer than a decade to recover. Previous experiences have revealed that bankruptcy can lead to emotional breakdown and even life threatening body conditions like a nervous breakdown and even stroke. Armed with this kind of information, your choice of a bankruptcy attorney to handle your case is a key factor to consider. Consequently, where to find an attorney is another question which should be answered very well. When seeking for a bankruptcy attorney, focus should be on three key factors. Experience, training and how much attention the attorney is prepared to pay to your needs.
The internet is the most readily available place to find a lawyer. You can also search for local lawyers via reputable professional associations and registrars' websites. Here, you will find a lawyer who is certified and fulfills all the requirements pertaining to the profession, which enhances his performance in these institutions. Remember that legal representatives are required to attend conferences and seminars that update them on changes in matters to do with bankruptcy. At this point, it is important to write down the details of the legal representatives listed on the sites which include names, phone numbers, head office and note the local legal bars with associate panels dealing with bankruptcy cases. In addition, find these professionals and ask several questions regarding their experience and level of expertise.
Once you have a list of selected lawyers, it is time to begin to find a legal representative that will work for your best interest. This requires you to make several appointments and prepare a comprehensive list of questions to ask during your interview. The most common questions you will deal with are about the experience of the law in the field. Questions like how many cases he has handled, how many cases he has won, his level of expertise, who will specifically represent you and the service package among other considerations. In addition, find a lawyer who is offering a free consultation for the first visit. This is because there is no point of paying for questions to be answered.
On this first interview, it is advisable to ask as many questions as possible to make sure that you will file for what you can afford. You will have substantial information on what the bankruptcy fees will likely amount to, and the most suitable chapter of bankruptcy to be filed. To find the most suitable lawyer, an interview is the avenue to use. During the interview, ask about the number of cases that are similar to yours that he has handled, until you are confident of one particular lawyer whom you find most confident and you can communicate well. Afterwards, review your notes and find an attorney suitable for you from the different interviews that you have held. The lawyer should satisfy your demand. Find an attorney who has the desired experience, is organized in handling his affairs, respected, holds a good reputation in the field of bankruptcy, able to give maximum attention by listening to your case and charges fair and reasonable legal fees.
You should be confident of picking the appropriate legal representative after you have interviewed more than one attorney. During the interviews, have a keen interest in the representation agreement, previous court notices and communications and any other relevant details that the legal representative has handled before. Do not hesitate to ask more questions after you have found an attorney to avoid holding incomplete information, which can lead to unpleasant surprises later.

Have A Bankruptcy Attorney Protect Your Stuff With Exemption Laws

Over the last couple years, over encumbered Americans have been searching for a way to eliminate their debt without losing all their property. The creditors want the debtors to believe that if they file for bankruptcy a big truck will pull up and haul away all their belongings. Because of this, many of these people searching for a solution get caught up in debt consolidation plans. Not knowing the benefits of filing bankruptcy can many times get these debtors in a further financial bind agreeing to a contract they can't afford. Before an individual signs up for one of these debt consolidation companies they should take the time to visit a bankruptcy attorney, if it's even just for comparison's sake.
After taking the time to visit a bankruptcy attorney, the individual will find out that when filing bankruptcy rarely do they lose any property at all. A Chapter 7 bankruptcy is called a liquidation bankruptcy, but most people that qualify to file Chapter 7 rarely have any property that won't be protected by bankruptcy exemptions. This is where a bankruptcy attorney can really be a big asset to a debtor filing for bankruptcy. Typically, they will know what's expected and what exemptions will fly in the district that they practice. In the case of a Chapter 13 bankruptcy, there is a repayment plan that allows the debtor to keep all their secured property if they can afford to continue paying on it.
When it comes down to it, bankruptcy wouldn't work if the law didn't include bankruptcy exemptions. We might as well go back to the days of debtor's prison, because if the debtor lost everything when filing bankruptcy there would be less risk-taking and basically no capitalism. What's interesting is, the states that have more generous bankruptcy exemption laws tend to attract more entrepreneurs. Small business owners want to know that if their business should fail, they would be able to file for bankruptcy and save something.
For many, bankruptcy exemption laws can be very confusing and a bankruptcy attorney will be a big help. If the debtor has moved out of state prior to filing bankruptcy, the bankruptcy attorney might have to delay the filing and possibly have to use the bankruptcy exemptions from the state that they moved from. The rule of thumb in a bankruptcy filing is the debtor needs to reside in the state for two years to use that state's exemption laws. The bankruptcy court is understanding and knows that people move so the debtor has to reside in the state they are filing bankruptcy for the greater part of 180 days or basically three months. If the bankruptcy exemptions from your state don't float your boat you can always use the federal bankruptcy exemption laws.
Although, this might sound confusing, the good news is a bankruptcy attorney of your liking can take the edge off the pain of filing bankruptcy. A bankruptcy attorney will be experienced with the local exemption laws and be able to protect the maximum amount of property while wiping out all dischargeable debt. In the end, the debtor can find themselves on the road to becoming debt-free.
